Protect Yourself — Report Your Injury

Proper reporting is the first and most important step to protecting your rights to workers' compensation. The longer you wait to report the injury, the more likely the insurer will be to use that against you to deny your workers' compensation claim.

Get medical treatment promptly, even if it's just to get "checked out." If your condition gets worse a few days later, you will already have documentation that the injury happened and that you sought treatment. This can be very important when your lawyer fights a claim denial.

Give your employer and your doctor accurate information about the accident and injury. If you have had back problems before, tell your doctor how these symptoms are different (different location, different degree of pain). Just because you had prior back pain or a prior, healed injury, that should not prevent you from getting compensation for THIS on-the-job injury. If you try to hide that information, however, it could be found out and it could hurt your case.
